The handling of any sensitive or student data in connection with a development project will be governed by the specific terms of the project’s Statement of Work (SOW) and applicable data processing agreements.

You consent to receive electronic communications and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically, via email and on the Site, satisfy any legal requirement that such communications be in writing.

All professional services provided by WEB WIDE are governed by a separate, formal Statement of Work (“SOW”) or Client Agreement. This SOW will detail the specific scope of work, deliverables, timelines, fees, and payment schedules for the project. The terms on this page do not supersede the terms of a signed SOW.

Children Under Thirteen

WEB WIDE does not knowingly collect personal information from persons under the age of thirteen through this Site. As a service provider to educational institutions, we acknowledge that our clients are responsible for complying with all applicable laws regarding student data, such as the Children’s Online Privacy Protection Act (COPPA).

webwideagency.com may contain links to other websites (“Linked Sites”). The Linked Sites are not under the control of WEB WIDE and WEB WIDE is not responsible for the contents of any Linked Site.

No Unlawful or Prohibited Use/Intellectual Property

The ownership and intellectual property rights for any custom software, code, or other materials developed and delivered as part of a client project will be explicitly defined in the governing Statement of Work (SOW) or a separate Intellectual Property Agreement.

International Users

The Service is controlled, operated, and administered by WEB WIDE from our offices within the USA. If you access the Service from a location outside the USA, you are responsible for compliance with all local laws.

Indemnification

You agree to indemnify, defend and hold harmless WEB WIDE, its officers, directors, and employees for any losses, costs, or expenses relating to or arising out of your use of or inability to use the Site or its services, or your violation of any terms of this Agreement.

Liability Disclaimer

THE INFORMATION AND SERVICES AVAILABLE THROUGH THE SITE ARE PROVIDED “AS IS” WITHOUT WARRANTY OR CONDITION OF ANY KIND. WEB WIDE AND/OR ITS SUPPLIERS SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING OUT OF THE USE OR PERFORMANCE OF THE SITE. ANY AND ALL LIABILITY RELATED TO THE CUSTOM SOFTWARE PRODUCTS AND SERVICES DELIVERED TO A CLIENT IS GOVERNED EXCLUSIVELY BY THE TERMS OF THAT CLIENT’S SIGNED STATEMENT OF WORK (SOW). IF YOU ARE DISSATISFIED WITH THE SITE, YOUR SOLE REMEDY IS TO DISCONTINUE USING THE SITE.

Termination/Access Restriction

WEB WIDE reserves the right, in its sole discretion, to terminate your access to the Site and its related services at any time, without notice. This agreement is governed by the laws of the State of Michigan.

Changes to Terms

WEB WIDE reserves the right, in its sole discretion, to change the Terms under which webwideagency.com is offered. The most current version of the Terms will supersede all previous versions.
